These terms apply to Rooftop Express: Train Runner ("the game", "we", "us") on every platform it is released on. By downloading or playing the game you agree to them. If you do not agree, please do not use the game. How we handle data is described in the Privacy Policy.

If you got the game from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If you got it from Google Play, the Google Play Terms of Service also apply. Where these terms conflict with the store's terms, the store's terms take priority to the extent they must.

1. Licence

We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the game on devices you own or control, for your own non-commercial entertainment. You may not copy, modify, sell, rent or redistribute the game; reverse-engineer it except where the law allows; or use cheats, bots, modified clients or exploits that give an unfair advantage or affect other players, leaderboards or ads.

2. Ads

The game is free and shows ads. Rewarded ads are optional: you choose to watch one in exchange for the reward shown, which is given only after the ad network confirms the ad was watched. If no ad is available, the reward may not be offered. We do not control the content of ads, which is supplied by third parties, and we are not responsible for products or services they advertise. Ads that seem inappropriate can be reported to us.

3. Coins, items and mystery boxes

Coins, outfits, stars and other in-game items ("virtual items") are earned or unlocked in the game. They are part of your licence to use the game: you do not own them, they have no real-money value, and they cannot be exchanged for money, sold or transferred outside the game. We may change how virtual items work, for example to rebalance the game. Virtual items may be lost if you delete the game or its data, unless the game offers a restore or cloud save feature. Mystery boxes contain cosmetic items only. If the game ever offers randomised items for real money, the odds will be shown before you buy.

4. In-app purchases

The game may offer optional purchases, such as removing full-screen ads or cosmetic items. Prices are shown in the store before you buy. Purchases are processed by Apple or Google, are tied to your store account and, for permanent purchases, can be restored on a new device using the game's restore option. Refunds are handled by Apple or Google under their policies, and nothing here affects your statutory rights. Unless the product description says otherwise, a purchase to remove ads removes full-screen ads only; optional rewarded ads stay available, and some modes (such as online multiplayer) may still include an ad. If a purchase does not arrive, contact us.

5. Online features and fair play

Some features, such as leaderboards (through Game Center or Google Play Games), multiplayer or events, may need an internet connection and accounts with third-party services, whose terms also apply. Please play fairly and respect other players: no cheating, harassment, offensive names, or attempts to disrupt servers or other players' games. We may remove scores, reset progress obtained unfairly, or block access to online features for anyone who breaks these rules.

6. Changes to the game

We may update, change, add or remove content and features, and we may discontinue online features or the game itself. Updates may be required to keep playing. We will try to give reasonable notice before discontinuing features you paid for, and where the law requires, offer a remedy.

7. Health and safety

The game contains flashing lights, explosions and fast motion. A small number of people may experience seizures or other symptoms when exposed to flashing images. If you or anyone in your family has a history of epilepsy, consult a doctor before playing, and stop immediately if you feel unwell. Take breaks, and never play while driving or in situations where you need to pay attention to your surroundings.

8. Ownership

The game, including its code, characters, art, music, sounds and name, belongs to us or our licensors and is protected by intellectual property laws. Third-party assets are used under their licences and credited in the game. "Apple", "App Store" and "Game Center" are trademarks of Apple Inc.; "Google Play" and "AdMob" are trademarks of Google LLC.

9. Disclaimer

To the extent permitted by law, the game is provided "as is" and "as available", without warranties of any kind, including that it will be uninterrupted, error-free, or that saved progress will never be lost.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, progress or virtual items, arising from your use of the game. Our total liability for any claim is limited to the amount you paid us for the game in the 12 months before the claim. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, fraud, or your rights as a consumer under the laws of the country where you live.

11. Termination

You may stop using the game at any time by deleting it. We may suspend or end your licence if you seriously or repeatedly break these terms. Sections 3, 8, 9, 10 and 13 continue to apply after termination.

12. Apple-specific terms

If you downloaded the game from the App Store: these terms are between you and us, not Apple, and we, not Apple, are solely responsible for the game and its content. Apple has no obligation to provide maintenance or support for the game. If the game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or any third party relating to the game, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property infringement claims; we are responsible for those to the extent required by these terms. You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. These terms do not limit any mandatory consumer protection rights you have under the law of the country where you live, and you may bring claims in the courts of that country where the law allows.

14. Changes and contact

We may update these terms, for example when features are added. The date at the top shows the latest version. If a change is significant, we will tell you in the game or on this page before it takes effect. By continuing to play after a change takes effect, you accept the updated terms.
